**RUDBLU APART HOTEL**
**REMOTE SALES AGREEMENT FOR RESERVATION / ACCOMMODATION**
**ARTICLE 1 / PARTIES:**
1.1. This agreement has been made between RUDBLU APART HOTEL, located at Hurma, 255. Sk. No:19, 07130 Konyaaltı/Antalya, with the phone number +90 530 663 15 66, and the customer/user (hereinafter referred to as the "customer") who makes a reservation through the system, agrees to the terms and conditions stated below by entering and confirming their personal information, including their name and IP address, and TC ID number or passport number in the reservation form.
**ARTICLE 2 / SUBJECT:**
2.1. This agreement covers the customer's reservation of products/services via the hotel, under the conditions explained below. In the event of a price increase in the contract amount, the additional difference will not be demanded from the consumer, nor will any discounts (referred to as actions) made by the facility be refunded to the consumer.
**ARTICLE 3 / CONTRACT PRICE AND PAYMENT:**
3.1. VAT is included in the contract price.
3.2. Hotel accommodation prices and other extras on the system are in TL, including taxes.
3.3. All services specified in the reservation are included in the contract price. Services not mentioned and any additional products or services obtained at the hotel are subject to separate charges, which will be paid upon check-out.
3.4. Customers purchasing discounted or promotional products are required to pay the full service fee at the time of reservation. The reservation will not be confirmed until the full payment is made.
3.5. Customers making reservations through www.rudbluhotel.com from abroad must pay in foreign currency. Invoices will be issued in TL based on the exchange rate of the TCM bank’s foreign currency selling rate on the day of departure, after the accommodation is completed.
3.6. For reservations made through www.rudbluhotel.com, confirmation and invoice delivery will be carried out by the RUDBLU APART HOTEL reservation department as follows:
3.7. **Instant Reservation Confirmation:** The reservation confirmation can be printed by the customer at the final stage of the system and will also be sent to the email address provided by the customer. The invoice will be issued and delivered to the customer after the accommodation has been completed and the customer has checked out.
3.8. Refunds will be processed within 30 days to the credit card used for the reservation or the customer's bank account.
**ARTICLE 4 / APPLICATION:**
4.1. It is prohibited to bring flammable, explosive, or hazardous materials or items that cause disturbance to the surroundings, as well as sharp or piercing tools and firearms, into the hotel premises unless written permission is obtained from the hotel manager.
4.2. The rules and information, including check-in and check-out times, are published on the room detail pages of the website.
4.3. The customer accepts in advance that they are responsible for any damage to the fixtures in the hotel or common areas during their stay and for covering the costs of such damage.
**ARTICLE 5 / DURATION AND TERMINATION:**
5.1. The customer will stay at the hotel during the dates of their reservation. If the customer wishes to extend their stay, they must request it from the hotel at least 1 day before the check-out date. If an available room exists, the stay will be extended after the customer pays the current rates. Otherwise, the customer must leave the hotel at 12:00 noon on the last day of their reservation.
5.2. Reservations made either verbally or in writing can be canceled by the customer via RUDBLU APART HOTEL's email address or by phone. In such cases, the amounts and rules stated below will apply. This cancellation fee corresponds to 100% of the reservation amount.
Cancellations can only be processed using the special reservation/voucher number provided to the customer during the reservation stage, along with the correct personal information. This number is assigned specifically to the customer and is provided for the customer's security. The customer is responsible for keeping this number confidential, as it will be used for reservation cancellations.
Cancellation Periods and Deduction Amounts (unless otherwise specified by the facility):
- Cancellations made up to 3 days before the check-in date: Free of charge.
- Cancellations made within 3 days of the check-in date: 100% of the reservation fee.
- In case of a "No-Show," the customer cannot claim a refund of the accommodation fee.
The customer agrees to the above cancellation policies, TURSAB regulations, and international NO-SHOW rules, and undertakes not to claim any refund from RUDBLU APART HOTEL.
5.3. The hotel reserves the right to partially or completely modify or cancel the announced or registered reservation, provided that the customer is informed, up to 3 days before the start date of the reservation. If the customer does not accept this change or cancellation, they have the right to cancel their reservation and receive a full refund. In such cases, the customer will not be entitled to any compensation.
5.4. The customer accepts the aforementioned deductions if they request a cancellation for reasons other than documented illnesses or deaths of themselves or their first-degree relatives, supported by an official report from a fully-equipped state hospital.
**ARTICLE 6 / FORCE MAJEURE:**
6.1. In cases where hotel services are incomplete or cannot be provided due to natural disasters, social events, international relations, technical failures, strikes, protests, or similar reasons that occur during or before the hotel reservation dates, the facility will not be held responsible.
**ARTICLE 7 / OTHER PROVISIONS:**
7.1. This agreement solely pertains to the hotel reservation, and the facility fulfills its contractual obligations by accepting the customer’s definite reservation request and issuing the reservation confirmation. In the event of any issues with the facility, the customer agrees to address their concerns solely to the accommodation facility management during their stay.
7.2. If the customer uses the service partially or fully despite having complaints during their stay, they accept not to claim any compensation or refund.
7.3. It is the duty of the customer, acting in good faith, to notify the authorized personnel in writing of any complaints during the service. If the customer fully uses the service without notifying the facility authorities, they waive their right to seek alternative services or refunds related to their complaints.
7.4. The customer acknowledges that they have read and signed this agreement after receiving all the information about the hotel through the website (www.rudbluhotel.com) or by phone. Any complaints about deficiencies or defective products during their stay will be based on the information provided to them.
7.5. Even if the customer is unable to sign this hotel reservation agreement for any reason, they are deemed to have accepted the terms of the agreement by receiving the information via the website, announcements, or emails sent to the specified email address.
7.6. If there is a discrepancy between the customer’s copy of the agreement and the hotel’s copy, the hotel’s records will prevail. Any email or fax communications between the parties will be considered conclusive evidence, and the company’s records will be deemed the basis for any disputes. The parties agree that the addresses and phone numbers they provided are valid for all communications and notices, and unless a written change is notified, any notices or communications sent to the specified addresses or phone numbers will be considered duly delivered.
7.7. The customer may choose to purchase insurance to cover return travel expenses in case of accidents or illness and any damages or medical expenses incurred during their stay.
7.8. Identity and age verification will be carried out upon check-in. Any discrepancies in age or identity declarations will result in payment of the difference at check-in. (All guests aged 11 and over are considered adults).
7.9. Price differences due to early reservation periods or system errors will not be charged to the customer, nor will refunds be made for discounts referred to as actions by the facility.
7.10. The hotel may send campaigns and notifications to the email address, postal address, or mobile phone number provided by the customer. By signing this agreement, the customer gives consent for such communications.
7.12. In the event of disputes between the customer and the hotel, the customer has the right to apply to the Consumer Court or Consumer Arbitration Board. As a gesture of good faith, the customer agrees to first submit their complaint in writing to the hotel’s customer service and allow 14 business days for a response before taking legal action.
**ARTICLE 8 / COLLECTION:**
8.1. By signing this document, I authorize RUDBLU APART HOTEL to collect the reservation amount using the credit card number provided above. If my credit card payment cannot be processed, I agree to pay the debt, including interest at the credit card’s interest rate. I have read, understood, and accepted this 8-page contract, consisting of 5 articles, and have signed and received copies of it. After signing this agreement, please send it to [email protected].
